DELICATO'S GENERAL PURCHASE AND DELIVERY TERMS
These general purchase and delivery conditions ("Terms") apply when you as a customer place an order from Delicato Bakverk AB ("Delicato/we/our/us"), with organization number 556119-4720, Grenvägen 9, 141 71 Segeltorp, e- postal address hej@shopdelicato.se, via Delicato's website https://shopdelicato.se/ ("Website"). Special terms and conditions for business customers apply and are described in applicable parts of the Terms and Conditions.
The provisions in, for example, the Consumer Purchase Act (2022:260), the Act (2005:59) on distance contracts and agreements outside business premises, the General Data Protection Regulation (European Parliament and Council Regulation EU 2016/679 of 27 April 2016) and, where applicable, other mandatory laws are applied to all purchases consumers make via the Website. In the event of any conflict between such applicable laws and these Terms, the laws take precedence.
Entering into a purchase agreement
Orders are placed via the Website and in connection with this you accept these terms and conditions as well as other terms and conditions found on the Website from time to time, including our privacy policy. When the order is received, Delicato sends a confirmation of the received order by sending an order confirmation. Order confirmation is sent via e-mail to the e-mail address you specified in connection with the order. Please note that a purchase agreement is only entered into when you have received order confirmation from Delicato. Delicato has the right to refuse the order in individual cases (for example, if you as a customer have provided incorrect personal data). We reserve the right to correct orders after order confirmation has been sent if delivery cannot take place for any reason. If you have placed multiple orders, we reserve the right to combine your orders and deliver them as one order.
Please note that you must be 18 years of age or older to enter into a contract with Delicato. By accepting these Terms, you certify that you are over 18 years of age.
Product information, prices and fees, etc.
All prices stated on the Website are in Swedish kronor and include value added tax (VAT). The prices listed are for the item itself, and additional charges may apply depending on the payment and delivery method you choose, as well as for unclaimed packages or failed home delivery. The total cost of your order is automatically calculated based on your selections and presented before you complete your order.
When ordering, the prices stated on the Website at the time of the order apply. Delicato reserves itself for any typographical errors on the Website. The prices are reported both before the order and in the order confirmation.
Delicato is not bound by such erroneous pricing that the customer realized or should have realized. If an incorrect price has been entered for a product ordered by the customer, we will notify you and await your approval of the corrected price before completing the purchase.
The product images on the website do not guarantee that the exact appearance and nature of the item is reproduced. We reserve the right for any errors in product information and reserve the right to change product information and prices without prior notice.
Delicato reserves itself for any errors in price and product information or otherwise on the Website. In the event of any inaccuracies on the Website, Delicato reserves the right to correct this afterwards. We reserve the right for price adjustments, final sales, inventory differences, technical problems, changes to technical specifications and any typographical errors on our site or in our advertisements. We reserve the right to cancel orders that are incorrect for any of the above reasons and orders that are otherwise deemed by us to be incorrect.
Immaterial rights
You agree that the content of the Website, including its source code and software, is protected by intellectual property rights and/or is a trade secret of Delicato, its partners or suppliers; which are legally protected under the legislation on business confidentiality as well as industrial rights and copyright. You also agree that the content of the Website, including the products and their appearance and content, is protected by copyright, trademark, patent or other rights under applicable law. If Delicato has not given its written consent regarding items that can be searched for or are available and/or can be purchased in connection with the provision of the Website, they may not be used, modified in whole or in part, copied, made available to others, rented, leased, borrowed , sold or marketed.
The names, logos and texts as well as the names of the goods and services presented on the Website are protected company names or trademarks and/or protected by other intellectual property rights. All trademarks on goods and services and all company names are owned by Delicato or one of our partners. These company names and/or trademarks may not be published or otherwise used without the prior written consent of Delicato.
Payment
Payment on the Website takes place through the applicable payment methods specified on the Website and in the Website's checkout. Payment methods may be removed or changed over time. We currently offer our customers the payment method credit card payment with cards connected to VISA, MasterCard and Maestro, Amex and UnionPay as well as instant cash with Google Pay, Paypal and Shop Pay. Purchases can also be financed with Klarna. When paying by credit card, your purchase is carried out immediately when the order is placed. All transactions are secure and encrypted.
As a customer, you undertake to pay within the specified time for the selected payment method. Payment after the due date may result in late fees and interest.
Promotions
In the case of temporary campaigns or offers, Delicato disclaims responsibility for the product selling out and possible printing errors. If attempts to use the offer in an unauthorized way are detected, Delicato has the right to cancel or adjust the order.
If you have received a complementary product free of charge in a campaign when purchasing a product, this complementary product must also be returned together with the original product in the event of a return.
Shipping and delivery
Delicato offers several different delivery options. Which delivery options are available depends on where you (the customer) live and which product you are purchasing. Current delivery methods and delivery times are stated in the checkout on the Website. Delivery is only possible to your civil registry address or the postal agent's nearest delivery point. Please note that Delicato is only able to offer delivery to addresses in Sweden.
Delicato normally handles your order within 24 hours (weekdays excluding holidays) from the order until the item leaves our warehouse, provided we have the item in stock. The delivery time for the product you ordered is stated at the time of ordering. In some situations, due to circumstances beyond Delicato's control, the delivery time may be longer. When the goods have left our warehouse, delivery responsibility passes to the shipping companies that deliver your order within the specified time for the selected shipping method. Delicato cannot provide any delay guarantee for goods that are not in stock at the time of ordering or for goods that have left our warehouse. This means that the total delivery time before the product reaches you may be longer than what is stated as normal for the selected shipping method.
Please note that during high season/larger promotions, the delivery time may be slightly longer. In the event of a delayed delivery, the transporting shipping companies will book a new date and time with you for when the delivery will take place. You will be informed if your delivery is delayed.

Right of withdrawal
When you as a consumer buy goods on the internet, you normally have a 14-day right of withdrawal according to the Act (2005:59) on distance contracts and contracts outside business premises. This means that you have the right to withdraw from the purchase agreement within 14 days from the time you took physical possession of the item or, in the case of ordering several items, from the time you took the last item for physical inspection. A condition, however, is that the item is unused and undamaged. If the item is not in unchanged condition, we may make a price deduction corresponding to the item's decrease in value. Please note that food products are exempt from the right of cancellation and cannot be returned, these include, among others, the pastries Delicatoboll, Punch roll and Mazarin provided by Delicato.
If you wish to exercise the open purchase option, you must notify Delicato within the 14-day period that you wish to withdraw from the purchase agreement and then return the product to Delicato. See the Return section for more information on how to register your return and return your product in order to complete your return case as quickly as possible.
When you, as a company, shop on the Website, we do not offer open purchase, but an opportunity to return the product within 14 days of the product being taken into physical possession. Returns for companies are only possible with unopened packaging and require you to follow Delicato's return instructions.
Return
When returning a product, you are responsible for the return cost. If you are a consumer, you can choose to use the Swedish Consumer Agency's standard form for right of withdrawal, which you can find here.
In order to be able to return a product, regardless of whether you are an entrepreneur or a consumer, you must be able to prove your purchase from the Website, e.g. with the receipt you received from Delicato when your order was shipped. Once we have received your return in stock and initiated the refund, a confirmation will be sent via email.
When returning a product, you register your return by contacting Delicato's logistics partner Expresspack Sweden AB, who handles returns on our behalf via e-mail to hej@shopdelicato.se.
Effect of exercised right of withdrawal
Delicato will refund the purchase amount paid without undue delay and at the latest within 14 days from when we have received the product in stock and approved the return. Confirmation of approved return will be sent to your e-mail address that you provided at the time of ordering. If you are a consumer, the time for reimbursement is calculated from the time Delicato has received the product. Refunds are made via the same payment method that was used at the time of ordering.
If, on the other hand, you use the product, remove labels or break any seals other than what is necessary to examine the product (determine the product's nature, characteristics or function), Delicato is entitled to compensation for the resulting decrease in value of the product. The product should therefore be sent back to Delicato in its original packaging. Note that companies' right to return requires unopened original packaging.
Complaint
If you have received a defective or incorrectly shipped product, please contact our customer service immediately at hej@shopdelicato.se. For complaints about pastry goods, fill in our complaint form.
Please describe the error in as much detail as possible. If we cannot solve the problem, you can of course complain about the product to get a new one. Complaints must be made in accordance with the instructions you receive from us. In the event of a dispute, we follow the recommendations of the General Complaints Board.
Depending on the extent of the error, redelivery, rectification or price reduction are carried out, for example. You may also have the right to cancellation, for example if the error is of significant importance. In the event of an approved cancellation, Delicato reimburses you for the cost of the product.
For claims for other compensation, in addition to the cost of the product, Delicato is responsible according to what follows from the Consumer Purchase Act or other applicable mandatory law. See the Consumer Purchase Act (2022:260) for more information about your rights in connection with errors and complaints.
Force majeure
Delicato is not obliged to perform the purchase agreement if the performance is significantly impeded as a result of an event beyond Delicato's reasonable control (for example, strike, natural disaster, war, rebellion, law enforcement or failure of electrical/telecommunication/data connections or other communication). If the circumstance has lasted longer than two months, both you and Delicato have the right to cancel the purchase agreement with immediate effect.
Right to cancel, cancel order, etc.
Delicato reserves the right to cancel orders before delivery. Delicato's intention is for delivery to take place in accordance with the delivery times specified for the selected delivery option, but delivery delays may occur. See the Consumer Purchase Act (2022:260) for more information about your rights in connection with Delicato's delay.
Personal data
Delicato collects and processes personal data in connection with your purchase, i.a. name, address, e-mail address and telephone number, among other things, to be able to fulfill the purchase agreement with you. Delicato Bakverk AB is the personal data controller for the processing of your personal data for the purposes stated in Delicato's privacy policy which you can find here. In our privacy policy, you will also find complete information about which personal data we collect and how we use it.
You can also subscribe to our newsletter when you register as a customer. You can cancel your subscription at any time, either via the link in the newsletter or by contacting our customer service.
We reserve the right to cancel orders that contain incorrect personal data and/or where the customer has payment complaints.
You have the right to (i) request information about our processing of your personal data, (ii) request that we correct inaccuracies in your personal data, (iii) object to or request limitation of our processing of your personal data, and (iv) request access to, removal of or transfer (so-called data portability) of your personal data. You also have the right to (v) withdraw your consent in those situations where you have given it. We may, under certain circumstances, refuse to process your request if it is unreasonably frequent, requires disproportionate technical effort, or risks the privacy of others.
